Terms and conditions

Who provides the service

Almendro is the registered trademark under which Alberth Gerardo Méndez Rodríguez, Costa Rican ID 2-0627-0652, provides custom software development services from San Ramón, Costa Rica.

That is the person you contract with and in whose name projects are invoiced.

What you are hiring

Almendro builds custom software: systems made for one company's actual operation. This is not an off-the-shelf product and not a monthly licence.

Before quoting there is a free diagnosis, where the need is documented and the scope is defined.

Quoting and approval

Every engagement starts from a written proposal with scope, deliverables, timeline, milestones and amount.

Work begins once that proposal is approved in writing by the client's authorised representative. Anything not in the proposal is not part of the engagement.

Payment

Custom projects are paid by bank transfer.

Almendro does not charge cards, does not set up recurring debits and does not use payment gateways for these projects. No card data is stored because none is received.

Amounts are always stated with the currency code (for example USD 1 500 or CRC 800 000) and are invoiced by milestone, as set out in the approved proposal. Every payment is backed by its electronic invoice.

Portal accounts

The client portal has no public sign-up.

Accounts are created by Almendro for the people the client designates, and are managed by the person responsible for that account. Whoever receives an account is responsible for their credentials and for what is done with them.

If you suspect someone else has access, write to support@almendro.cr so it can be closed.

Timelines and scope changes

The proposal's timeline assumes the client delivers on time the information, access and approvals that depend on them.

A scope change during development is quoted separately, in writing, and may move the delivery date. No change is carried out without approval.

Ownership of the work

Once fully paid, the code written specifically for the project belongs to the client, who may modify it or hand it to another provider.

This excludes Almendro's own reusable components and third party libraries, which are delivered under their own licence.

The client owns their data at all times and may request an export.

Warranty and support

After delivery there is a warranty period stated in the proposal, during which defects in what was delivered are fixed at no cost.

The warranty does not cover new features, scope changes, or failures caused by third parties or by changes made outside Almendro.

Ongoing support, if contracted, follows what the proposal states.

Confidentiality

Almendro treats as confidential any client information it accesses during the project and does not share it with third parties outside the work.

This obligation remains in force after the project ends.

Termination

Either party may end the relationship with written notice.

The client pays for the work done up to that date and receives whatever is finished, with its source. Amounts for milestones already delivered and approved are not refunded.

The online products have their own terms

Electronic invoicing (fe.almendro.cr) and e-commerce (ecommerce.almendro.cr) are separate products, with their own terms and their own billing, published on their own sites.

These terms do not cover them.

Governing law and contact

These terms are governed by the laws of the Republic of Costa Rica.
